Interview with Odalys Garcés Fernández, director of the Havana Trade Real Estate Agency

What does the local lease tender consist of? What are the main dates of the procedure in Havana?

"The tender begins with the summons of the Governor of Havana, opening the process. This is a novel process, it is the first time it has been done, it has no precedent, and its fundamental objective is the tender for the furniture of the internal trade that forms part of the state network, which is the use and enjoyment of these properties as a lease The Municipal Assembly of the Provincial Government approved 174 units to tender, of which 41 service units and 133 gastronomy units, in the fifteen municipalities of the capital.

On June 1st, the governor opened the bidding process and later we spent three days in a public call for the units to be bid in five municipalities, since this process is carried out gradually. The first municipalities Playa, Plaza Centro Habana, Cerro and Regla, with a total of forty-four units, at this first moment. This strategy by municipality was carried out with an oscillation of 35 to 45 units so as not to burden the process so much with units.

The law states that there are thirty business days to complete the process in thirty days. On Monday, June 7, we began to collect the projects of the colleagues who are going to present and tender these properties and this process in the aforementioned municipalities will take place until June 17.

The rest of the municipalities cannot arrive yet, until those municipalities are opened. On the 20th, 21st and 22nd is the opening of the projects before the notary. On the 23rd, the winning offer is presented and selected to the Board of Directors, after which the proposal is approved and there are two more days, 24 and 27, for communication to the winning offeror.

The second group will be published on the twentieth, while the process with the first municipalities is still underway. The municipalities of this group are Guanabacoa, Old Havana, Marianao, Boyeros and La Lisa and this very day the call for locals begins for three days. As of the 23rd, the projects of this group, which has a total of 42 properties, begin to be collected.

If a bidder does not deliver his project on time, what happens?

"The tender is closed and at the end that all the municipalities are tendered, it starts again with the first in a second call with what is left." For example, if I have three properties left from Cerro, I don't take them out together with the second group. I withdraw Cerro and start with the second group. When the fifteen municipalities are finished, I will go over the remaining ones again.

After the communication of the winning bid to the bidder, what are the steps to follow?

The bidder then comes to carry out the contractual process in the real estate agency.

Can it be the case that several projects are presented for a single property?

But it may be that for a property three or four projects are presented that we have and that is why the pertinent reasons are given to select the winner and all the bidders who presented in the same property are present. It is explained with reasons such as the example that the project you presented is linked to social work in the community, because it serves vulnerable families, because it works with the day care center, because your offers have cheaper prices, etc.

What should a project carry for bidding?

In general, the projects are for service because in ten days it is impossible for people to do a project that includes all the technical part that they have to develop for repairs within a building, because that requires a visit to the place, which the architect and the engineer intervene, among other things. Rather, the projects are service projects where they express what they are going to do in that place, what are the benefits that the community is going to have, what is the state and social mandate that is going to be given to that place and all the general characteristics, but associated with the service.

After the contract, does the accompaniment of the real estate company continue?

Yes, the bidder has a year after the contract to repair the place, but this year they are monitored by the real estate agency. This repair runs for the economy of the selected bidder. What we do support them in everything that is collateral, for example the electricity of the place, the water, the light, everything that has to do with the purchased services that they can make their contract both with the real estate agency that collects them the resolution 97 or both with the companies of these services.

What are the laws that govern this bidding process?

The resolution no. 40 of the Ministry of Internal Trade and annexed to it the procedure for the lease of premises of the internal trade system.

The projects can be presented from 9 a.m. to 4 p.m. at the Provincial Real Estate Agency of Havana located on Carlos III between Requena and Almendares no. 1005-1007.

They will be attended by Silvia Almenteros Alfonso, deputy director of the real estate company, and Milagro González Hernández, member of the bidding commission in charge of receiving the projects.
